The Supreme Court annulled the Police order for the retention of exhibits in the Central Prison documents case.
The Supreme Court held that ‘the trial Court, in issuing an Order for the Retention of Exhibits not referred to in the Search Warrant, which Search Warrant had not been issued by it but by another Court, acted in excess of its jurisdiction.’
Accordingly, the Supreme Court issued a prerogative writ of Certiorari sought by Alexandros Clerides, by virtue of which the Order for the Retention of Exhibits was quashed to the extent that it concerned items not referred to in the search warrant. It is noted that the search warrant was annulled insofar as it related to notes, and it was held that, based on the investigator’s affidavit, only mobile phones and computers ought to have been seized.
Ακυρώθηκε απο το Ανώτατο το διάταγμα κατακράτησης τεκμηρίων της Αστυνομίας για την υποθεση εγγράφων Κεντρικής Φυλακής.
Το Ανώτατο κατέληξε πως «το πρωτόδικο Δικαστήριο προχώρησε στην έκδοση διατάγματος Κατακράτησης Τεκμηρίων που δεν αναφέρονταν στο Ένταλμα Έρευνας και το οποίο Ένταλμα Έρευνας δεν είχε εκδοθεί από το ίδιο αλλά από άλλο Δικαστήριο, ενήργησε καθ' υπέρβαση της δικαιοδοσίας του».
Ως εκ τούτου το Ανώτατο εξέδωσε προνομιακό ένταλμα Certiorari που αιτείτο ο Αλέξανδρος Κληρίδης, με το οποίο το Διάταγμα Κατακράτησης Τεκμηρίων, στην έκταση που αφορά αντικείμενα που δεν αναφέρονταν στο ένταλμα έρευνας, ακυρώνεται. Σημειώνεται πως το ένταλμα έρευνας, ακυρώθηκε σε ότι αφορά τις σημειώσεις και κρίθηκε πως, με βάση τον όρκο του ανακριτή, θα έπρεπε να παραληφθούν μόνο κινητά και ηλεκτρονικοί υπολογιστές.
