In a judgment delivered on 24 September 2026, the Larnaca District Court dismissed an application seeking wide-ranging interim injunctions in a dispute concerning the use of a registered trademark, related branding and domain names.
Although the Court found that the applicant had established an arguable case in relation to trademark infringement, it held that the balance of convenience favoured refusal of the injunctions. Of particular importance was the fact that the disputed name had been used publicly for approximately eight years with the applicant’s written consent or acquiescence before registration of the trademark. The Court held that this longstanding commercial use had become part of the status quo and should not be overturned through interim relief.
The Court also declined to determine at the interim stage the full legal effect of the earlier consents and years of acquiescence, holding that these matters required proper examination at trial.
