NORWICH PHARMACAL DISCLOSURE ORDERS GRANTED IN PROPERTY MANAGEMENT DISPUTE

In a recent interim decision of the Nicosia District Court, the Court granted an application for Norwich Pharmacal disclosure orders in proceedings concerning the management of jointly owned immovable property and the collection of rental income. The application sought the disclosure of tenancy agreements, rental records, bank statements, accounting records, and other documents relating to the management of the properties, following allegations that the defendants had acted under a power of attorney and failed to account for rental income and related transactions. The Court granted the application, recognising that the disclosure sought was necessary to enable the claimant to properly investigate and pursue his substantive claims.

The application was successfully argued by Antonis Georgiou, Partner at Phoebus, Christos Clerides & Associates LLC. The decision provides useful guidance on the availability of Norwich Pharmacal relief in Cyprus and reaffirms the Court’s willingness to order disclosure of documents and information where this is necessary to facilitate the proper administration of justice and the effective pursuit of civil claims.
