The recent judgment of the Supreme Court in Civil Appeal 193/2016 is an important reminder that, in the sensitive field of compulsory Expropriations, the judicial power to determine “fair and reasonable compensation” is not unlimited. The Court does indeed have the discretion to accept or reject elements from the experts’ reports, but it is obliged to exercise that discretion with clear, reasoned and well-substantiated findings.

Μια διοικητική πράξη/ απόφαση μπορεί να ακυρωθεί με απόφαση Διοικητικού Δικαστηρίου για διάφορους λόγους στην οποία όμως περίπτωση το άτομο που επηρεάστηκε από αυτή την απόφαση δικαιούται πλέον να διεκδικήσει αποζημιώσεις από τη Δημοκρατία για τη ζημιά που έχει υποστεί λόγω αυτής της απόφασης από τη διοίκηση η οποία προκάλεσε στο άτομο απώλεια ή και βλάβη.

ΑΝΤΙΣΥΝΤΑΓΜΑΤΙΚΗ Η ΑΠΑΓΟΡΕΥΣΗ ΕΞΟΔΟΥ

Το Άρθρο 13.2 του Συντάγματος κατοχυρώνει το δικαίωμα "να εγκαταλείψει" κάποιος την Κύπρο μόνιμα ή προσωρινά. Σύμφωνα με το ίδιο άρθρο είναι δυνατόν να επιβληθούν εύλογοι περιορισμοί δια νόμου. Αυτό προϋποθέτει ότι δεν είναι δυνατόν να απαγορευθεί η έξοδος σε οποιονδήποτε από την Κύπρο εκτός εάν υπάρχει Νόμος ο οποίος προνοεί για το θέμα και σύμφωνα με τον οποίο το δικαιώμα αυτό της ελευθέρας εξόδου υπόκειται σε εύλογους περιορισμούς.
