SUCCESSFUL OPPOSITION TO JURISDICTION CHALLENGE IN PATERNITY PROCEEDINGS

In proceedings before the Family Court of Larnaca, the firm successfully represented the applicant in opposition to an intermediate application by the respondent challenging the jurisdiction of the Court in proceedings concerning paternal recognition and related genetic testing.

The applicant was represented by Antonis Georgiou, Partner, who opposed the jurisdictional objection on the basis that the Family Court of Larnaca had jurisdiction under the applicable provisions of the Family Courts Law.

The respondent argued that the Court lacked jurisdiction because the applicant was habitually resident in the United Kingdom and relied on provisions of the Children (Kinship and Legal Status) Law. The applicant opposed the application, arguing that jurisdiction was properly founded, inter alia, because the respondent resided within the Republic and specifically within the district of Larnaca.

The Court held that the matter was governed by the Family Courts Law and that the Family Court had jurisdiction in matters concerning recognition of a child where the parties, or one of them, reside in the Republic. The Court further held that, since the respondent resided in Larnaca, the Family Court of Larnaca was the competent Court.

The respondent’s application challenging jurisdiction was accordingly dismissed, with costs awarded in favour of the applicant.
